Welcome to Butterfly Forever. These Terms & Conditions ("Terms") are a legal agreement between you and 2020 Innovation Corporation ("Butterfly Forever," "we," "us," or "our"), governing your access to and use of butterflyforever.net and all related features (the "Service"). By creating an account, checking the acceptance box at sign-up, or otherwise using the Service, you agree to be bound by these Terms and by our Privacy Policy and Community Guidelines, which are incorporated here by reference.
If you do not agree to these Terms, please do not use the Service.
You must affirmatively accept these Terms when you register for an account. Continuing to use the Service after we post changes to these Terms means you accept the updated Terms — see Section 17.
You must be at least 18 years old, or the age of majority in your province, state, or country, to create an account. The Service is not directed at children, and we do not knowingly collect account information from anyone under 18. A memorial or living memorial page may of course concern or depict a person of any age — that restriction is about who may hold an account, not who may be remembered.
You're responsible for the accuracy of the information you provide, for keeping your login credentials confidential, and for all activity that occurs under your account. Tell us right away at support@butterflyforever.net if you believe your account has been accessed without authorization.
Butterfly Forever lets people create memorial pages to honor someone who has passed, and living memorial pages to curate their own life story while living. Features may include photos, videos, written tributes, a guided AI Eulogy Assistant, community forums, direct messaging between accepted friends, virtual gifts, and a member directory. Features available to you depend on your membership tier (Free, Basic Memory Keeper, or Premium Memory Keeper) as described on our Plans page, which may change from time to time.
A free memorial remains private and intact indefinitely — we do not delete or restrict access to a memorial for non-payment. Upgrading a plan expands reach (directory listing) and richness (unlimited media, video, full life-story sections) but never determines whether a memorial continues to exist.
Basic and Premium Memory Keeper plans are paid subscriptions billed monthly or annually, processed securely through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.
Virtual Gifts (Candle, Butterfly, Dove, Flowers, and similar items) are one-time purchases processed through Stripe, available to any visitor or member regardless of subscription tier. Virtual Gifts and store items are digital or symbolic goods; because they're delivered immediately upon purchase, all sales are final except where required otherwise by applicable consumer protection law, or where we determine in our discretion that a refund is appropriate (for example, a technical error resulting in a duplicate charge).
You retain ownership of the photos, videos, text, and other content you upload or post ("User Content"). By posting User Content, you grant Butterfly Forever a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute that content solely as needed to operate, maintain, and promote the Service (for example, displaying a memorial to its intended audience, or generating a QR code or shareable link). This license ends when you delete the content or your account, except for content that other users have shared or that we're required to retain (for example, backups or legal records).
You represent that you have the right to post the content you submit, and that it does not infringe anyone else's rights or violate these Terms or our Community Guidelines.

We may remove content, restrict features, or take the enforcement steps described in Section 9 for violations of this Section.
The person who creates a memorial is its "Memory Keeper" and has primary curatorial control — including approving or declining photo contributions from friends, pinning tributes, and managing privacy settings. We understand that memorials can be emotionally significant to many people beyond the Memory Keeper, and that disagreements about a memorial's content sometimes arise among family members. Butterfly Forever is not able to mediate family disputes over memorial content; where we're asked to intervene, we'll generally defer to the account holder of record unless we receive a valid legal request (such as a court order or documentation establishing succession) directing otherwise.
We offer an account succession process allowing a Memory Keeper to designate a Legacy Contact who can request transfer of a memorial's stewardship, subject to our manual review and approval. Details are available in your account settings.
Any member may report content they believe violates these Terms or our Community Guidelines. We review reports and may hide, remove, or restrict content, and may apply a trust status to an account (in serious or repeated cases, up to suspension) as described in our Community Guidelines. We aim to act thoughtfully given the sensitivity of our community, but we reserve the right to make these determinations at our discretion.
The Butterfly Forever name, logo, site design, and underlying software are owned by 2020 Innovation Corporation and protected by applicable intellectual property laws. Nothing in these Terms grants you rights to our trademarks or branding except as needed to use the Service as intended (for example, a white-label Premium memorial removes our branding from that specific page by design).
The Service relies on third-party providers to operate, including Stripe (payments), Supabase (database, authentication, and file storage), DreamHost (transactional email), and — where you choose to embed one — YouTube (video playback). Your use of embedded YouTube content is subject to YouTube's own terms, and you're responsible for ensuring any video you link to doesn't infringe copyright; YouTube's own Content ID system may independently block playback of videos containing copyrighted music, which is outside our control. Where you use our AI Eulogy Assistant, drafts are generated using Anthropic's Claude API; see Section 11 of our Privacy Policy for how that data is handled.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT, EXCEPT WHERE SUCH DISCLAIMERS ARE NOT PERMITTED BY LAW. We do not guarantee that the Service will be uninterrupted, secure, or error-free, or that content will be preserved indefinitely, though preserving your memories is central to why we built Butterfly Forever and we take reasonable steps — including regular backups — to protect against loss.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, 2020 INNOVATION CORPORATION AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, GOODWILL, OR PROFITS, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) CAD $100. Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.
You agree to indemnify and hold harmless 2020 Innovation Corporation from claims, damages, and expenses (including reasonable legal fees) arising from your User Content, your violation of these Terms, or your violation of any third party's rights.
You may close your account at any time from Settings. We may suspend or terminate an account that violates these Terms, our Community Guidelines, or applicable law, or that we determine poses a safety risk to our community. Except where content violates these Terms, closing your own account does not delete memorials you keep — ownership transfer or memorialization options are available; contact us for guidance.
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. You agree that any dispute arising from these Terms or the Service will be resolved in the courts located in Ontario, Canada, unless applicable consumer protection law in your jurisdiction requires otherwise.
We may update these Terms from time to time. For material changes, we'll provide reasonable notice (such as an email or an in-app notice) before the change takes effect. Continuing to use the Service after that point constitutes acceptance of the revised Terms.
