1. Overview

Butterfly Forever exists to help people hold onto memories, which means we're entrusted with some of the most personal information there is — details about the people you've loved and lost. We take that responsibility seriously. This Privacy Policy explains what we collect, why, how it's used, and the choices available to you.

2. Information We Collect

3. How We Use Your Information

  • To provide, operate, and maintain the Service, including displaying memorials to their intended audience;
  • To process payments and manage subscriptions;
  • To send transactional emails you'd reasonably expect (receipts, friend requests, new messages, memorial anniversary reminders) — each of these can be turned off individually in Settings → Email;
  • To moderate content and enforce our Community Guidelines, including reviewing reported content;
  • To respond to support requests;
  • To detect, prevent, and address fraud, abuse, or security issues;
  • To comply with legal obligations.

We do not sell your personal information. We do not use your memorial content, photos, or messages to train third-party advertising systems.

4. Who We Share Information With

We share information only as needed to run the Service, with providers bound by their own confidentiality and security obligations:

  • Stripe — payment processing;
  • Supabase — our database, authentication, and file storage provider;
  • DreamHost — sends transactional email on our behalf;
  • Rewardful — tracks affiliate referrals for members of our affiliate program (only for members who choose to use an affiliate link — see Section 8);
  • Anthropic — powers the AI Eulogy Assistant (see Section 5);
  • Other members — content you post to a memorial or public profile is visible according to that content's privacy setting (Private, Friends, or Public), exactly as you've configured it;
  • Legal authorities — where required by law, such as a valid court order or to protect the safety of our community.

5. The AI Eulogy Assistant

When you use the AI Eulogy Assistant, the details you provide (such as the person's name, relationship to you, and memories you share) are sent to Anthropic's Claude API to generate a draft. This tool is available without requiring login. We don't use these conversations to train our own product's underlying AI models beyond generating your requested draft, and we recommend reviewing Anthropic's own privacy practices for details on how they process API requests.

6. Content About Deceased Individuals

Memorial pages necessarily contain information about people who have passed away. Canadian privacy law (like most privacy law) is generally framed around living individuals, and Butterfly Forever's memorial features exist specifically because that gap matters to families. As a matter of policy — not just legal minimum — we extend the same content-review and takedown process described in our Community Guidelines to memorials, regardless of whether the subject is living or deceased, and family members with a legitimate connection to a memorial can contact us regarding its content.

7. Data Retention

We keep your account and content for as long as your account is active, and free memorials remain intact indefinitely even without a paid subscription — see our Terms, Section 3. If you close your account, we retain the minimum information necessary for legal, tax, and fraud-prevention purposes, and otherwise delete or anonymize your personal information within a reasonable period. Memorials you've created may be transferred to a designated Legacy Contact through our succession process rather than deleted, if you've set that up.

8. Cookies & Similar Technologies

We use strictly necessary cookies to keep you logged in and remember your preferences. If you arrive via an affiliate link, a small first-touch attribution marker is stored in your browser for 30 days so the referring affiliate can be credited — this contains only a referral code, not personal information, and is separate from your account data.

9. Security

We use industry-standard measures to protect your information, including encrypted connections (HTTPS), database-level access controls (Row Level Security), and hashed password storage. No system is completely secure, and we can't guarantee absolute security, but we take this seriously given the sensitivity of what our community shares with us.

10. International Users & Data Transfers

Butterfly Forever is operated from Canada, and our service providers may process data in Canada, the United States, or other countries where they operate. By using the Service, you understand your information may be transferred to and processed in countries other than your own, which may have different data protection laws than your home jurisdiction.

11. Children's Privacy

The Service is not directed at children, and account holders must be 18 or older (see our Terms, Section 2). We do not knowingly collect personal information from children under 13. If you believe a child has provided us with personal information, please contact us and we will take appropriate steps to remove it.

12. Your Rights & Choices

Depending on where you live, you may have rights to access, correct, delete, or receive a copy of your personal information, and to object to or restrict certain processing. You can update most of your information directly in Account Settings, manage email preferences in Settings → Email, or contact us using the details below for anything you can't do yourself. We'll respond to verified requests within a reasonable time.

13. Breach Notification

If a security incident occurs that creates a real risk of significant harm to you, we will notify affected individuals and applicable regulators as required by PIPEDA and other applicable law.

14. Changes to this Policy

We may update this Privacy Policy from time to time. For material changes, we'll provide reasonable notice before the change takes effect.
